Reusable packaging obligation as of 01-01-2023

From January 1, 2023, the Europe-wide reusable packaging obligation for gastronomy businesses, catering companies and food retailers comes into force. The law obliges catering establishments to offer their customers reusable alternatives for food and beverages, such as reusable boxes, containers or reusable cups, in addition to disposable packaging. These must not be more expensive than the disposable solutions, but requiring a deposit is possible. For gastronomic businesses with up to five employees and a sales area of up to 80 square meters, there is relief – they can also fill the food and beverages into customer containers they bring with them.

The goal of obligatory reuse is to reduce the waste generated by disposable tableware and to-go packaging, thus making a positive contribution to environmental protection and sustainability. Reduced VAT rate until the end of 2023

Due to the current energy crisis, the reduced VAT rate of 7% will remain in effect until the end of 2023. This applies to all food and catering services in gastronomy. Excluded from the regulation are beverages, which must continue to be taxed at the standard rate of 19%. The reduced VAT rate is intended to relieve restaurateurs of the increased operating costs in the industry.
